What is a Cease and Desist Letter?


A cease and desist (or demand) letter is correspondence that states or suggests that a person or business is infringing on your trademark and demands that they stop using your trademark. 


Why Do I Need a Cease and Desist Letter?


It is the responsibility of trademark owners to police their trademarks. The United States Patent and Trademark Office (USPTO) does not police trademarks, it only registers them. You want to stop other's from using your trademark because failure to do so may result in the proliferation of your excat or similar trademark within your industry. If this occurs your trademark may lose its distinctiveness and the USPTO may refuse to renew your trademark.
